RESOLUTION NO. 2025-[XX]

ADOPTION OF COMPREHENSIVE ARTIFICIAL INTELLIGENCE POLICY
FOR [SCHOOL DISTRICT NAME]

WHEREAS, artificial intelligence (AI) technologies are rapidly transforming educational practices and are increasingly present in K-12 educational settings, presenting both significant opportunities for enhanced learning and important considerations for student safety and privacy; and
WHEREAS, the Board of Education of [School District Name] recognizes its responsibility to provide comprehensive governance and oversight to ensure the safe, ethical, equitable, and effective use of AI tools in our schools while maintaining the highest standards of educational excellence; and
WHEREAS, clear and comprehensive policies are necessary to protect student privacy rights under the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), and applicable state privacy laws, while ensuring equitable access to AI technologies for all students regardless of socioeconomic background; and
WHEREAS, the District has a duty to maintain academic integrity, foster critical thinking skills, and prepare students to be responsible digital citizens in an AI-enabled society and workforce; and
WHEREAS, extensive stakeholder engagement has been conducted over the past [TIME PERIOD], including input from administrators, teachers, support staff, students, parents, and community members through surveys, focus groups, public forums, and task force meetings; and
WHEREAS, the AI Task Force, established by Board Resolution [PREVIOUS NUMBER] on [DATE], has thoroughly researched best practices, reviewed policies from exemplary districts nationwide, consulted with legal counsel and technology experts, and developed comprehensive recommendations for AI governance that align with our district's mission and values; and
WHEREAS, the proposed Artificial Intelligence Acceptable Use Policy has been carefully reviewed by district legal counsel for compliance with all applicable federal and state laws, aligned with existing district policies on technology use, academic integrity, and student data privacy, and incorporates feedback from all stakeholder groups; and
WHEREAS, the Board finds that the adoption of a comprehensive AI policy is essential to provide clear expectations for students, staff, and families, protect the interests of all stakeholders, position our district as a leader in responsible AI integration, and ensure our students are prepared for success in higher education and future careers;

NOW, THEREFORE, BE IT RESOLVED by the Board of Education of [School District Name], in regular session assembled this [DATE], as follows:

Section 1. Policy Adoption. The Board hereby adopts the Artificial Intelligence Acceptable Use Policy, attached hereto as Exhibit A and incorporated herein by reference, to be effective immediately upon adoption.
Section 2. Implementation Authority. The Superintendent or designee is authorized and directed to:
  1. Implement the AI Policy across all schools, departments, and programs within the District;
  2. Develop and promulgate administrative regulations, procedures, and guidelines necessary for effective policy implementation;
  3. Establish and maintain an approved list of AI tools and platforms that meet district standards for privacy, security, and educational value;
  4. Coordinate comprehensive professional development for all staff members on AI tools, ethical use, and integration strategies;
  5. Integrate age-appropriate AI literacy education into the curriculum at all grade levels;
  6. Communicate the policy and its requirements to all stakeholders including students, parents, staff, and community members in multiple languages as needed;
  7. Monitor compliance with the policy and report regularly to the Board on implementation progress.
Section 3. Budget Authorization. The Board authorizes the allocation of up to $[AMOUNT] from the [FUND NAME/SOURCE] for the current fiscal year to support:
  1. Professional development and training programs for staff;
  2. Procurement of approved AI tools and platforms;
  3. Technical infrastructure improvements necessary to support AI implementation;

Section 5. Student and Parent Rights. The Board affirms that:
  1. Parents/guardians retain the right to review AI tools used by their children;
  2. Parents/guardians may request alternative assignments if they object to AI use;

  4. Procedures for addressing concerns about AI use shall be clearly communicated;
  5. No student shall be penalized for lack of access to AI tools outside of school.
Section 6. Equity Provisions. The Board commits to ensuring:
  1. Equitable access to AI tools for all students regardless of socioeconomic status;
  2. Provision of necessary devices and internet connectivity for students in need;
  3. Alternative learning opportunities for students unable to access AI tools;
  4. Regular monitoring and addressing of any disparate impacts of AI implementation;
  5. Culturally responsive AI implementation that reflects our diverse student population.
Section 7. Compliance and Legal Requirements. This policy shall be implemented in full compliance with:
  1. Family Educational Rights and Privacy Act (FERPA);
  2. Children's Online Privacy Protection Act (COPPA);
  3. Individuals with Disabilities Education Act (IDEA);
  4. Section 504 of the Rehabilitation Act;
  5. All applicable state education and privacy laws;
  6. District policies on non-discrimination and equity.
Section 8. Severability. If any provision of this Resolution or the attached Policy is held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions, which shall continue in full force and effect.
Section 9. Effective Date. This Resolution and the attached Policy shall take effect immediately upon adoption by the Board.
